Dividing Property in a Houston Divorce

What Happens to Our Property?

Assuming the house is community property (meaning it is subject to division in the divorce), it will depend on a variety of factors. If there are children living in the house and the parent who obtains primary conservatorship is able to continue to pay for the financial obligations (mortgage, escrow, taxes, etc) then many times a court will award the house to that spouse. But that is not always the case.

If both spouses would be able to continue to pay for the house and pay the other spouse their community property interest (through refinancing, a lump sum payment, or additional money elsewhere in the divorce settlement), then it can be a coin toss. If both parties desire the house and cannot make a decision, then a judge could order the house sold and the proceeds split evenly between the parties. If one party has a majority of the retirement funds in their name, then the other spouse may be awarded the house with all of its equity.

Texas is not a spousal-maintenance friendly state, so it is not guaranteed that a spouse will have to pay for support after a divorce. Dividing Retirement in a Houston Divorce

How are retirement accounts handled in a divorce?

A Texas court will divide all community property assets in a just and right division. To do this, a court will look at all of the assets and debts in calculating how to divide the assets. If each party has similarly sized retirement accounts, then the court may award each party their own retirement account. If a court deems that one party is entitled to funds from the other spouse’s retirement account to ensure a just and right division, then a Qualified Domestic Relations Order (QDRO) will be signed by the Court. A QDRO is the legal document that directs the plan administrator of a retirement account to issue funds from the account to the spouse being awarded the money. The money can then be rolled over into an IRA or the receiving spouse can elect to receive cash, which may have tax implications.
