Can Gay Couples Adopt in Texas, and What Are Texas’s Same Sex Adoption Laws?
There are no same sex adoption laws in Texas. On paper, Texas does not prohibit same sex couples from adopting. In other words, no statute says only heterosexual married couples can adopt. In fact, after the 2015 Supreme Court ruling in Obergefell v. Hodges, same-sex couples gained the constitutional right to marry, and with it, the same legal access to adoption as their straight counterparts.
Legally, gay couples can adopt in Texas. But here’s the part most couples don’t know: while the law is neutral, practice isn’t always. Some judges and courts still apply heightened scrutiny.
